A big day in the law

Supreme Court Justices Pose For Annual PortraitThe Supreme Court today has some major, important cases that popped up today. It’s rare I can look at what the court did any one day and actually be happy with most of the results.

First, Justice Ginsburg got one right. (But yes, I had to put up a terrible photo of her anyway). She stayed the sale of Chrysler to Fiat in order for SCOTUS to hear the case. Imagine that– the Supreme Court might be worried about the Obama administration deciding, on a whim, to throw out contract law!

The state of Indiana argued that as a bond holder through their pensions plan, they want their expected investment back.  This obviously means the General Motors deal is at risk, perhaps slowly down Obama’s breakneck pace of takeovers, at least for a while.

The other big story is more about what the Court didn’t do, which was take an appeal on the military’s “Don’t Ask, Don’t Tell” policy on homosexuals in the armed forces. And what would you know– there was the Obama administration, arguing against the grant of certiorari! I guess his big promise to the homosexual interest groups have failed.  Just like Bill Clinton before him (who instituted the policy) Obama has betrayed some of his biggest supporters. If the homosexual voting bloc actually noticed this and Obama’s opposition to gay marriage they might have to decide to think about other issues when they vote besides their sexuality– and might find themselves supporting states’ rights conservatives (Because right to marry in some states has to be better than none- yes?) Judge Andrew Napolitano said today that he believes this means SCOTUS is making room for legislation to be made accordingly, but that doesn’t make sense to me. Although that would be the best course of action for SCOTUS, Obama’s justice department should have just skipped the hearing, or put up a meager opposition, and allow the courts a chance to take the heat off him and the Democrats and possibly invalidate it.  A real missed opportunity for him.

All the while, Europe is going further to the right.

And I also got a great assignment for my summer job.  Not to get too much into that, but to summarize: I will know require everyone to call me Jack McCoy/Sam Waterson.
